Permission and Use FeesPurpose of Use FeesCopyright status has not been determined for many of the photograph and audiovisual materials in the Kansas State Historical Society's collection. However, materials appearing on kansasmemory.org (our digital collections repository) have been reviewed to determine that dissemination via the Internet will not violate the rights of known copyright holders or state or federal privacy laws. Users of materials are required to complete a permission form. A copy of the permission form will be enclosed with each photograph order, and additional copies can be obtained upon request. When the completed permission form is returned, an invoice will be issued for use fee charges. Use fees will be determined from the information on the permission form, and fees must be paid prior to the date of publication or broadcast. Use fees are in addition to other processing and service charges. Use fees are divided into two categories: nonprofit and commercial. Nonprofit fees are applicable only to those organizations able to prove legal non-profit status by providing suitable documentation such as tax-exempt certificates or letters of identification. Kansas State Historical Society reserves the right to waive fees or other requirements on an individual basis at the discretion of the curator of photographs or the Society's director. Such waiver of fees can be made only upon approval of written application. |
